A LEGITIMIDADE NO USO DA FORÇA

Resumo

Este trabalho aborda o emprego das Forças Armadas em Operações de Garantia da Lei e da Ordem, do ponto de vista da legitimidade no uso da força pelo Estado, com base em revisão de literatura. A fim de analisar esta recente forma de uso da força pelo Estado, buscou-se compreender a histórica relação entre as Forças Armadas e a sociedade, bem como identificar as percepções desta ação pela sociedade, fazendo uma análise sumária da realidade brasileira. O objeto de estudo é investigar a legitimidade do uso da força estatal ao longo do tempo e conforme as atuais condições do modelo adotado. A análise busca contribuir com o fortalecimento do poder do Estado brasileiro, ao permitir identificar oportunidades de

melhoria a fim de regular este uso ao nível ótimo que garanta a manutenção da legitimidade do poder do Estado.

Abstract: This paper deals with the use of the Armed Forces in Law and Order Assurance Operations, from the point of view of legitimacy in the use of force by the State, based on a literature review. In order to analyze this recent form of use of force by the State, it was sought to understand the historical relationship between the Armed Forces and society, as well as to identify the perceptions of this action by society, making a summary analysis of the Brazilian

reality. The object of study is to investigate the legitimacy of the use of state force over time and according to the current conditions of the model adopted. The analysis seeks to contribute to the strengthening of the power of the Brazilian State by allowing the identification of opportunities for improvement in order to regulate this use at the optimal level that guarantees the maintenance of the legitimacy of State power.
